UK Mom Seeks Stricter Laws To Protect Pre-Born Babies Like Her Son


At 23 & 5 weeks pregnant, Emma Fairbairn started off May 25th of last year like any other - but it turned out to be a day that would change her life forever. On her way home from visiting the nursery her son would be in after his birth, she was involved in a serious car crash. 

She and her pre-born son were rushed to the hospital via ambulance where they both were treated. Filled with hope after feeling him kick in the ambulance & being informed that scans showed everything was normal, she breathed a sigh of relief. She and her baby boy were going to be ok!


They were admitted for observation and later that evening a devastated Emma was told his heartbeat could no longer be found. 

3 days later Fairbarin was induced and she gave birth to her stillborn son, Flynn , weighing just 1 lb 6 oz at 24 weeks & 1 day. 

It was medically confirmed that she had suffered a Complete Placental Abruption that was caused by the hard impact from the crash on Flynn. 



Because her son was born after the 24 week mark, he has a birth certificate and a stillbirth (death certificate); the cause of death is written down as ‘road traffic accident’ and was signed by her medical team.

There is currently no law in the UK or many other locations across the globe that legally allow mothers/parents to seek justice for babies, like Flynn, who die INSIDE the womb whether it be through a motor vehicle accident or assault. 

If Emma’s son was born breathing then succumbed to his injuries from the crash she would have been backed by the law. This is unacceptable and needs to change! He was a human being with a beating heart and his whole life ahead of him - yet the law doesn’t see him as worthy of protection just because of his location at death. 

The man who caused the death of Flynn has admitted responsibility and has since been charged with driving without due care and attention, getting off with a slap on the wrist - 6 points and a £100 fine.

UK children and their parents deserve better!

Emma has started a petition in hopes to change the laws in her country of the UK.

“I  know I will never get justice for him because this is the law at the time of the crash but for future pregnant woman and babies this needs to change!” says Emma.
